I listed a new Sony digital camera on eBay and it was cancelled by eBay with the following message:

"MC019 eBay Listing Removed: Trademark Violation - Unauthorized Listing Content

The listing was removed because it violated eBay policy.

The rights owner or an agent authorized to act on behalf of the rights owner, Sony Electronics, Inc., notified eBay that this listing violates intellectual property rights. When eBay receives a report of this type of violation, we remove the listing to comply with the law."

I really dont have any clue why?

I mentioned "1 Year Sony Warranty". Is that the issue?. The camera carries 1 year warranty. Is it void when i sell?

Update: You are right. Warranty claim is the issue. I have to remove the warranty claim and list i guess.

Representing manufacturers warranties is pretty risky and opens you up to SNADs.

Warranties often apply for purchases from authorized resellers and are often not transerable.

In the future you'd be better off stating the following:

"Item is new but please check with the manufacturer regarding warranty coverage."

When selling a newer item, I usually just say that I will include a copy of the sales receipt. Whether people want to interpret that as my way of proving the item is almost new or a possible opportunity to be covered under warranty is up to them.

The issue here is that big companies like Sony want you to buy their products new so they make the profit. Claiming copyright infringment is the easiest way to eliminate competition from the "used" market.
I can see if you are using their pictures or promotional copy from their webiste, but sheesh, some of companies are ridiculous... especially @pple and Micro$oft!

Only thing I don't like about that is you are exposing where you bought the item and how much you paid. Not a problem if you are selling it just to get rid of it but if you're selling for profit, I would think most buyers might be upset to see how much you actually paid for the item opening you up to more disputes and low DSR's.

I always get a gift receipt and state it in the ad that I will send that with. I can't stop them from drawing their own conclusions then AND it not directly listed with the price. If they try to return it & find out it was bought for less, hopefully they already have left the feedback by then & then they might open themselves up to some sort of claim of deception.

You should probably plan to keep the camera so you can capture your own images

I had two of my Sony camera listings taken down three times.
- Once it was indeed due to the pictures (wish I came across this post earlier).
- The second time around it was due to the warranty sentence which I removed completely only levaing that the item is brand new and sealed
- The third time I received a notice that the listing is taken down after all the cameras are sold.

In neither of 3 cases i had a reason listed in the email. All the time I had to give them a call so that the representative could enlighten me. On my third contact with e8ay I was told that it was due to teh copyright infringement (whatever the hell this means).

On a different ocasion I had 2 open boxes listings with Adobe Photoshop taken down. The software was completely legal and purchased from a liquidator. The listings were taken almost immediately, again, with no explanation. I checked the part numbers - the softares were totally retail version, I listed tham as used with no implied guarantees... I think e8ay VeRo program is totally screwed up and was solely intended to help e8ay covering their asses.

Every company manufacturer can find out 1000 reasons why your e8ay listing infringes a copyright and frivolously request e8ay to take your listing down. They don't even required to explain why if the they invoke a Copyright Infringement clause.

So no warrantee if you give a camera as a gift?
